1. The service

Build Spend is a mobile tool for organizing construction projects, budgets, categories, tags, expenses, and related records. Features may change as the service develops. Build Spend is currently provided without paid subscriptions, in-app payments, or advertising, though these may be introduced in the future with appropriate notice and updated terms where necessary.

2. Eligibility and availability

You must be at least 18 years old and legally able to enter into a binding agreement to use Build Spend. The app may be available in countries and regions supported by Google Play, but availability of specific features may differ by location, device, platform, or law.

3. Accounts and security

You must provide accurate account information and keep it current. You are responsible for maintaining the confidentiality of your credentials and for activity under your account. Notify us promptly if you suspect unauthorized access. You may sign in using email or a supported third-party provider such as Google or Facebook; your use of that provider is also governed by its terms.

4. Limited license

Subject to these Terms, Arvin Apps grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use Build Spend for lawful personal or internal business purposes. You may not copy, sell, sublicense, reverse engineer, bypass security, or commercially exploit the service except where applicable law expressly permits it.

5. Acceptable use

You agree not to:

• use Build Spend unlawfully, fraudulently, or to infringe another person’s rights;
• upload malicious code or content you do not have the right to use;
• attempt unauthorized access to accounts, systems, or data;
• interfere with the service, overload it, scrape it, or circumvent access limits;
• use the service to store highly sensitive credentials or regulated information for which Build Spend is not designed.

6. Your content and responsibilities

You retain ownership of project, expense, profile, and other content you enter or upload. You grant Arvin Apps a limited license to host, process, reproduce, and transmit that content only as needed to provide, secure, maintain, and improve Build Spend.

You are responsible for the accuracy, legality, and backup of your content and for obtaining any permissions needed to enter information relating to clients, suppliers, workers, or other people. Do not use Build Spend as the only repository for records you are legally required to preserve.

7. Privacy

Our Privacy Policy explains how we collect, use, disclose, retain, and protect information. By using Build Spend, you acknowledge those practices.

8. Third-party services

Build Spend relies on services provided by third parties, including Google Firebase and optional Google or Facebook authentication. Third-party services may be unavailable, changed, or governed by separate terms. Arvin Apps is not responsible for third-party services beyond what applicable law requires.

9. Construction and financial disclaimer

Build Spend is an organizational tool, not accounting, financial, tax, legal, engineering, surveying, or construction-management advice. Budgets, totals, reports, and other outputs depend on the information you enter and may contain errors or omissions. You are responsible for independently checking important figures, maintaining appropriate records, and obtaining qualified professional advice before making project, contractual, safety, tax, or financial decisions.

10. Availability, changes, and termination

We may update, suspend, limit, or discontinue all or part of Build Spend for maintenance, security, legal, or operational reasons. We may suspend or terminate access if you materially violate these Terms, create risk or harm, or if required by law. You may stop using the service at any time and request account deletion by emailing apps.arvin@gmail.com.

11. Warranties and liability

To the fullest extent permitted by law, Build Spend is provided “as is” and “as available,” without warranties of uninterrupted availability, error-free operation, fitness for a particular purpose, or preservation of all data.

To the fullest extent permitted by law, Arvin Apps will not be liable for indirect, incidental, special, consequential, or punitive loss, or for lost profits, savings, business, opportunities, or data arising from use of or inability to use Build Spend. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, or any mandatory consumer rights.

12. Responsibility for claims

To the extent permitted by law, if your unlawful use of Build Spend, your content, or your violation of these Terms causes a third-party claim against Arvin Apps, you agree to be responsible for the resulting reasonable losses and costs. This section does not apply where prohibited by consumer law.

13. Governing law and disputes

These Terms are governed by the laws of Sri Lanka, without regard to conflict-of-law principles. Before filing a formal claim, please contact us and allow a reasonable opportunity to resolve the issue. Unless mandatory law gives you another right, disputes will be subject to the competent courts of Sri Lanka. Mandatory consumer protections in your country remain unaffected.

14. General terms

If a provision is unenforceable, the remaining provisions continue in effect. A delay in enforcing a right is not a waiver. You may not transfer these Terms without our permission; we may transfer them as part of a business reorganization or service transfer. These Terms and the Privacy Policy form the agreement between you and Arvin Apps regarding Build Spend.

15. Changes to these Terms

We may update these Terms as the service or law changes. We will post the revised version here, update the effective date, and provide additional notice where a material change or applicable law requires it. Continued use after revised Terms take effect means you accept them, where permitted by law.
